Terms & Conditions
1. COURSES
1.1 King’s Education Ltd reserves the right to change course arrangements without prior notice.
2. ENROLMENTS
2.1 All enrolments must be understood and signed by the student (or parent if student is aged under 18).
2.2 King’s Education Ltd reserves the right to accept or decline any student.
2.3 Enrolment is confirmed only when Kings Education receives full payment of fees.
2.4 New Zealand law requires all international students to have full medical and travel insurance for their stay in New Zealand. King’s Education Ltd cannot finalise enrolments without evidence of insurance protection.
2.5 The New Zealand Immigration Service has a medical screening requirement for international students intending to stay in New Zealand more than six months. This will apply if students:
- Intend staying in New Zealand longer than six months
- Have not previously provided a full medical screening test to the NZIS
- Do not hold a passport from a low TB risk country
- Have spent three months or more in a country not identified as a low TB risk country
3. PAYMENT OF FEES
3.1 Fees may be altered in certain circumstances (eg change in tax).
3.2 Fees must be paid in advance, 21 days before the course begins, for the period of study requested on the Enrolment Form or when the invoice is received.
3.3 All fees are calculated in complete weeks and any part of a week is counted as a full week. No compensation is given for public holidays when King’s Education Ltd is closed.
3.4 Tuition fees for courses are held in the Public Trust account until 7 days after the course begins.
3.5 Student Fee Protection - King’s Education Ltd complies with NZQA requirements to protect student fees. Student fees are not at risk in the event of the closure of King’s Education because money is held in a Public Trust Account.
3.6 Fees and enrolment are valid for 2007 and 2008 and are subject to changes and currency fluctuations that may occur.
4. STUDENT FEE PROTECTION
All student fees are protected by Public Trust and approved by NZQA
5. CANCELLATIONS, WITHDRAWALS AND REFUNDS
4.1 In accordance with the Education Amendment Act 1999:
- Cancellations made in writing fourteen (14) or more days before course commencement will result in a full refund of all course fees less the administration fee of $150.
- Cancellations made in writing less than fourteen (14) days before course commencement will result in a refund of all fees, less 10% of the total fee (or $500, whichever is the lesser).
- Students enrolled in a course of up to and including four (4) weeks and six (6) days will be refunded 50% of course fees, if they withdraw in the first two (2) days of the course.
- Students enrolled in a course of five (5) weeks or more, but less than three (3) months will be refunded 75% of course fees, if they withdraw in the first five (5) days of the course.
- Students enrolled in a course of more than three (3) months will be refunded all fees, less 10% of the total fee (or $500, whichever is the lesser), if they withdraw in the first seven (7) days of the course.
- Tuition fees, except 10% of the total fee (or $500, whichever is the lesser), will be held in a trust account until seven (7) days after a student's course begins.
- The refund of any service fees charged by an agent must be claimed from the agent separately.
- Refunds on compassionate grounds may be granted at the descretion of a Director and must be requested in writing.
- If a student withdraws after the first seven (7) days of the course, refunds may only be given at the discretion of a Director. A 10% administration fee will be charged.
- Enrolment extensions will not be given to students taking a holiday during their course unless agreed on at enrolment.

6. HOLIDAY LEAVE DURING COURSES
5.1 A maximum of one week’s holiday leave without loss of tuition fees may be taken after each twelve weeks of study upon prior approval by a director of the company. No refunds or extensions of courses will be granted for holiday leave in excess of this allowance.
5.2 At least one week’s notice of request for leave must be given. If not, a holiday credit may not be given and tuition fees will be lost.
5.3 Extensions because of holidays can only be given in Foundation English courses.
7. ACCOMMODATION
6.1 Homestay accommodation includes accommodation, breakfast and dinner daily. Lunch will also be provided on Saturday and Sunday. Weekday lunches are available as an optional extra.
6.2 Any cancellations or changes to homestay accommodation must be notified at least two weeks (14 days) before the cancellation or change. Failure to do this will mean an extra payment of two weeks accommodation fee.
6.3 Accommodation fes are worked out by the day if an enrolment is for a week only.
6.4 The student must be prepared to leave the arranged accommodation when he/she has finished his/her studies at the school.
6.5 King's Education Ltd acts as an agent for homestay accommodation and cannot be held responsible for any accident, illness or damage to a student or goods that may happen during the student's stay with a host family. The student is responsible for providing insurance to cover these needs.
6.6 Any national or international telephone calls from the homestay accommodation must be approved by the host family and any charges reimbursed directly to the host family immediately.
8. SCHOOL RULES
7.1 The rules set by King's Education are to help the school run smoothly. All students who enrol with King's must accept and comply with these rules as a contractual condition of enrolment.
7.2 King's reserves the right to refuse entry to a course for any student suffering from a mental or physical disability, if such a disability could affect their own or others safety or academic achievement.
7.3 Any student who breaks the school rules or behaves badly will be issued with a warning letter. If there is no improvement in the behaviour, King's may expel the student from the school.
7.4 Students must obey New Zealand laws. If a student commits an offence (breaks the law), or is convicted of an offence, he or she may be expelled from the school immediately. Any student who is expelled will not be entitled to a refund of any paid money.
7.5 The New Zealand Immigration Service will be informed if a student is expelled from the school.
9. LIABILITY
8.1 King's Education is not liable for any damage, loss or injury to students or their property, however caused, except where any liability is imposed by the laws of New Zealand.
8.2 King's requires students to purchase personal insurance to cover theselves against accident, illness, theft, loss or damage to personal possessions, and the loss of fees through non-arrival of the student, absence or unexpected termination of their course.
8.3 King's is not liable to any student if contracted services cannot be provided for any reason beyond its control.
8.4 King's reserves the right to alter a course if necessary.
8.5 Students must be aware that all decisions with respect to work permits and visas are made by Immigration New Zealand (INZ). King's Education or it's retailers do not accept any liability should student applications for work permits in New Zealand be unsuccessful.
10. VALIDITY
9.1 These conditions are valid from 1 January 2007 and remain valid until replaced by new terms and conditions.
11. CODE OF PRACTICE
10.1 King's Education has agreed to observe and are bound by the "Code of Practice for the Pastoral Care of International Students" provided by the Ministed of Education. Copies of the Code are available from the New Zealand Ministry of Education website at http://www.minedu.govt.nz/goto/international.
